The Supreme Court, by the now standard 6-3 majority, has rewarded Trump and made his purging of voter rolls easier by allowing him to use an error-ridden DHS database to determine citizenship, and hence, the ability to vote. It stays adverse rulings by the DC district and circuit courts, pending the outcome of the full appeals process, which will take many months longer than we have before the November election. It’s the standard, unsigned, per curiam, decision, but appears to have been authored by Chief Justice Roberts, who receives appeals from the DC Circuit and who sent it on to the full court. Justice Jackson writes the dissent, joined by Justices Sotomayor and Kagan, starting on page 8 of a 19-page opinion. [W]ithout full briefing or oral argument, this Court now grants one—rendering questionable interim rulings about two statutory provisions it has never before interpreted. The Court also focuses only on the harms the Government will purportedly suffer absent a stay, disregarding the harms that the modified SAVE system has caused, and will likely continue to cause, to lawful voters. The Court thus misuses its equitable powers. Accordingly, I respectfully dissent. I *believe* that whenever a shadow docket opinion is rendered, whether named or not, the justice responsible for that circuit crafts the order. This would be in keeping with the sense that this is the justice who provides emergency oversight of that circuit, and so they would be the one to report the ruling out.
